Understanding voyeurism allegations
Section 162(1) addresses surreptitious observation or visual recording of a person in circumstances giving rise to a reasonable expectation of privacy, where an additional statutory condition is met. Those conditions concern the setting, the person’s state and the purpose of observation or recording, or a sexual purpose. The Crown must prove the applicable elements beyond a reasonable doubt. Section 162 also contains a separate provision concerning dealings with recordings known to have been obtained through voyeurism.
Preparing your voyeurism defence consultation
Use the documents for your own matter to guide the discussion. Depending on the circumstances, Karandeep can review:
- The alleged observation or recording and the provision actually charged
- Privacy expectations in the particular circumstances and whether conduct was surreptitious
- Device access, file attribution, timestamps, and the integrity of digital evidence
- Search authority, seizure records, disclosure completeness, and potential Charter issues
What to do before you contact us
Keep charging and release documents, note the next court date, and contact the office before taking any action with potentially relevant files or devices. Follow all restrictions. A consultation can begin with a brief description of the allegation; detailed material should be handled through arrangements made with your lawyer.
Preparing a consultation from Mississauga
Separate the place where you live, the place of the alleged incident, and the court listed on your documents. A Mississauga address does not settle which building you must attend. Keep the court notice beside your consultation questions so the two appointments can be planned separately.
If you are coming to the Mayfield Road office, confirm the appointment before travelling from Mississauga. Tell us whether work hours, a driving restriction, or family responsibilities affect your availability. Ask what can be discussed at the first meeting and how any remaining documents should be provided.
Check the court named on your Mississauga paperwork
If your documents name the Brampton courthouse, its listed address is 7755 Hurontario Street in Brampton. Your consultation at our Mayfield Road office and your court appearance are separate appointments.
Official Brampton court information
Follow the instructions for your particular proceeding. A published video link does not mean you may attend remotely when an in-person appearance is required. If the location or attendance method is unclear, confirm it with your lawyer or the court.
